Waiver & Liability Release

BIKE RIDERS & PARTICIPANTS

Participation in any Ashland Climate Collaborative group bike ride, parade, volunteer activity, or related event (“Event”) requires agreement to the terms below. By signing, you acknowledge that you understand and accept these terms.

Assumption of Risk

I understand that bicycling, riding in parades, being a passenger on a bicycle, and volunteering at Events involve inherent risks, including but not limited to falling, collisions, mechanical failures, weather or environmental hazards, and the actions of others. I voluntarily assume all risks, including those arising from the negligence of Ashland Climate Collaborative, its organizers, volunteers, sponsors, or other third parties, except for risks that cannot legally be waived under Oregon law.

Release of Liability

I hereby release and discharge Ashland Climate Collaborative; Event sponsors and organizers; and any affiliated agencies, officers, employees, and volunteers from all claims arising from or related to my participation in any Event, including claims arising from their negligence. This release does not waive claims for gross negligence, recklessness, intentional misconduct, or other liabilities that Oregon law does not allow to be waived. This release applies to all Event activities, including walking, assisting, volunteering, or riding as a passenger.

Indemnification

I agree to defend, indemnify, and hold harmless Ashland Climate Collaborative and all parties listed above from any claims, losses, or expenses (including attorneys’ fees) arising from my participation in an Event, except to the extent caused by the gross negligence or intentional misconduct of an indemnified party.

Medical Consent

I consent to emergency medical treatment deemed necessary until I or a legally authorized representative can take responsibility. I agree to be responsible for all related costs.

Safety Responsibilities

I understand that:

  • I am responsible for my own safety and conduct.
  • All riders must wear a bicycle helmet meeting CPSC, SNELL, ASTM, or ANSI standards.
  • I must follow traffic laws, Event rules, and directions from Event organizers and authorities.
  • My bicycle and equipment must be in safe working condition.

Representations

I represent that I am physically able to participate safely in Event activities.

Photography/Media Release

I allow Ashland Climate Collaborative to use photos or videos of me (or my child) taken during Events for non-commercial organizational purposes without compensation UNLESS I clearly communicate otherwise.

Property & Event Changes

I understand that Ashland Climate Collaborative is not responsible for lost or damaged personal property. I understand that Events may be delayed, modified, or canceled for reasons beyond the organization’s control, and that fees may not be refunded.

Governing Law and Severability

This agreement is governed by Oregon law. Any disputes shall be resolved in the courts of Jackson County, Oregon. If any part of this agreement is found unenforceable, the remainder shall continue in full force.

Minors (ONLY if participant is under 18)

Minors ages 12–17 may participate unaccompanied only with a parent/guardian’s signature.

By typing my name below, I agree to all terms of this Waiver & Liability Release on behalf of the minor(s) and accept full responsibility for their participation.
